ALL ABOUT ICSI ELECTION 2014



Dear Friends,

ICSI Election for Central Council and Regional Council will be held on 12th  & 13th December 2014. However whenever I asked my friends that to who they are going to support, I got following replies;

“Bhai Pta hi nai yeh Central Council Kya hai or Regional Council Kya hai…..
“Pta nai bhai koon koon contestant hai_____ kisi ko bhi vote de denge…….

Even I was confused because we all will cast our vote first time in upcoming election scheduled to be held on 12th & 13th December 2014. 


Approximately10,000/- new members has added since 2010 in institutes member's register and these 10,000 members will cast their vote first time in this upcoming election. 

I am sharing whatever I have learned after reading Company Secretaries Act, 180 and Rules, Regulation made thereunder. Hope this will be beneficial to you;

  

 CENTRAL COUNCIL

WHAT IS CENTRAL COUNCIL?

Institute of ‘Company Secretaries of India’ (ICSI) is artificial judicial person like a Company and just like Companies need directors to manage its affairs and discharge its functions, Central Council is a committee of members, constituted in accordance with the provisions of section 9 of the CS Act 1980.

HOW MANY MEMBERS ARE THERE IN CENTRAL COUNCIL?
It have total Twenty (20) members, consisting Fifteen (15) elected members and Five (5) government nominated members.


ELECTION FOR CENTRAL COUNCIL

The tenure of council is four (4) years from the dare of its first meeting. After this period elections are called. However the former council remains continue until a new council is constituted. A member of the former council is eligible for lection but no member can hold office for more than two consecutive terms. Moreover a member who has been elected as president is not eligible for re-election.

The Last Council was constituted in Year 2010 whose term is expired therefore the next elections are being held on 11-12 December 2014

FUNCTIONS OF CENTRAL COUNCIL
The Institute functions under the overall control, guidance and supervision of the Council and the duty of carrying out the provisions of Company Secretaries Act are vested in the Council.
In particular the duties of the Council are as below—
(a)    to approve academic courses and their contents;
(b)    the prescribing of fees for the examination of candidates for enrolment;
(c)    the prescribing of qualifications for entry in the Register;
(d)   the recognition of foreign qualifications and training for purposes of enrolment;
(e)    the prescribing of guidelines for granting or refusal of certificates of practice under this Act;
(f)     the levy of fees from members, examinees and other persons;
(g)    the regulation and maintenance of the status and standard of professional qualifications of members of the Institute;
(h)   the carrying out, by granting financial assistance to persons other than members of the Council or in any other manner, of research in such matters of interest to Company Secretaries as may be prescribed;
(i)      to enable functioning of the Director (Discipline), the Board of Discipline, the Disciplinary Committee and the Appellate Authority constituted under the provisions of this Act;
(j)      to enable functioning of the Quality Review Board;
(k)    consideration of the recommendations of the Quality Review Board made under Clause (a) of section 29B and details of action taken thereon in its annual report; and
(l)      to ensure the functioning of the Institute in accordance with the provisions of this Act and in performance of other statutory duties as may be entrusted to the Institute from time to time.

REGIONAL  COUNCIL


WHAT IS REGIONAL  COUNCIL?


To advise and assist in discharging the functions of Central Councils Regional councils are constituted.  The tenure of regional  council is four (4) years from the dare of its constitution . After this period elections are called . The Last regional Council was constituted in Year 2010 whose term is expired therefore the next elections are being held on 11-12 December 2014

FUNCTIONS OF REGIONAL COUNCIL

The Regional Councils advise and assist the Central Council in discharging the functions of Central Councils. In particular a Regional Council may—

(a)               provide facilities for the members and students of the Institute in its region for regular meetings, talks and lectures and for the acquisition and dissemination of useful information and updating of professional knowledge on subjects of interest to the profession of Company Secretaries;

(b)               advise the Council on all matters referred to it by the Council and offer such other help as may be required.

(c)                make representations to the Council in connection with matter of professional and business interest and offer suggestions for raising the standard and status of the profession;

(d)                propagate among the members the advisability of and the necessity for observing the rules of professional conduct, etiquette and the provisions of the Act and these regulations;

(e)                arrange, if desired by the Council, for coaching, for candidates for the  examinations of the Institute and  charge such fees as may be directed by the Council;

(f)                 organize study circles, refresher courses, symposia, seminars, regional conferences and other professional development programmes for the benefit of the members and students of the Institute and others and charge from them such fees as it deems necessary;

(g)                constitute a permanent Research Sub-committee for carrying out research work and for giving guidance in and encouragement for research by members in various fields of interest to the profession;

(h)               organize a student facilities committee for the benefit of the registered students preparing for the Institute’s examination;

(i)                  take steps for formation of Chapters in the region in accordance with the guidelines issued by the Council from time to time and to supervise their activities; and

(j)                  carry out such other functions as may be entrusted to it from time to time by the Council.

There are four regional councils, each regional councils is responsible for regional constituencies falling under its region. From each regional councils have minimum six and maximum 12 members.

WHO ARE ELIGIBLE TO VOTE?


A member, whose name is borne on the Register on the 1st day of April of the financial year in which the election to the Council is to take place, shall be eligible to vote in the election from the regional constituency within whose territorial jurisdiction his professional address falls on 1st April 2014.
